Terms, conditions, and policies

Thank you for your interest in De Waterkant Guest Suites, a business of the Elizabeth Crookes Trust in Cape Town, South Africa.

Governing law

These terms, conditions and policies are governed by South African law and in particular the Consumer Protection Act (Act 68 of 2008) as amended.

General terms

"Guest", "you" and "your" refers to a natural or juristic person who transacts with us. "We", "us" and "our" refers to the Elizabeth Crookes Trust trading and doing business as De Waterkant Guest Suites.

Refund and cancellation policy

We will consider all requests for full or partial refunds subject to the terms for short-term and long-term stays below. Where this policy refers to a "Full Refund" that amount is a total amount paid by Guest to us in South African rand (ZAR). We are responsible for ensuring that Guest receives that amount when a refund is legally appropriate. Please bare in mind that we, not Guest, are responsible for the payment of payment processing and other contractual fees to any payment service provider who facilitates the collection of the payment for Guest's order. Refunds from payment service providers directly to Guests will be deducted from the available payout pending to us or the balance in our account with the payment service provider (whichever is applicable). If the pending payout or balance in our account with the payment service provider is not enough for a Full Refund or partial refund to Guest (as applicable), then we will issue the refund from our own bank account to a bank account in Guest's name.

For short-term stays (that is, up to 27 nights per booking), we offer a Full Refund without any deductions for cancellations up to 30 days before arrival. Guests who cancel 7-30 days before check-in get 50% back without deductions. Closer than 7 days the amount paid is completely non-refundable.

For long-term stays (that is, 28 nights and longer per booking), guests receive a full refund without any deductions if the booking is cancelled within 48 hours of booking and at least 28 days before check-in. After that, the first 30 days of a stay are non-refundable.

All requests for full or partial refunds will be considered in accordance with South African law. The granting of full or partial refunds outside of legal requirements will be at our discretion.
